***Coggins And Health Certificate***

All catalog horses entered in this sale must have a current coggins and health certificate. No exceptions.

***Brand Inspection*** All consignments of branded horses entered in this sale require a brand inspection or a coggins and health clearly indicating the brand and its location. No exceptions

STATEMENT: Please include a short, honest & accurate description of the horse. Statement will be included in the catalog and website to describe the horse to potential buyers. Consignor will be liable for all statements. Sale management will not be held responsible for any statements made by consignor.

Required Paperwork & Photo/Video Submissions:

• Original or copy of AQHA or APHA papers

• Signed transfer report

• High Quality Digital Photograph (under 25 MB)

• High Quality Digital Video (between 80 - 100 MB)

• Negative Coggins paperwork (dated within 6 months of sale date)

• Current Health Certificate

• Brand Inspections (noted on health papers for Oregon horses)

• HYPP N/N Test results if horse is descended from the stallion Impressive

Photographs: High quality digital photographs(under 25 MB) are required for all entries and will be included in the sale catalog and may be used for website and social media promotions. We prefer a saddled side profile shot for the catalog. When you fill this form you will be sent an email with a paperwork upload link.

Videos: High quality digital videos(between 80 - 100 MB) are recommended for all entries. They will be played while the consigned horse is in the sale ring and may also be used for website and social media promotions. Videos must be uploaded to youtube.com and a link as well as a downloaded version of the video must be submitted. When you fill this form you will be sent an email with a paperwork upload link. Submissions are due no later than April 1, 2026 Videos received after this date may not be played or posted.

PLEASE NOTE THAT ALTHOUGH WE TRY TO INCLUDE EVERY HORSE CONSIGNED IN SOCIAL MEDIA PROMOTIONS, THERE ARE NO GUARANTEES MADE BY THE PENDLETON CATTLE BARONS COMMITTEE. PLEASE BE SURE TO INCLUDE PHOTOS AND VIDEOS OF HIGH QUALITY. ALL ENTRIES WILL BE PHOTOGRAPHED AND VIDEOED DURING THE EVENT AND INCLUDED IN PCB AND OTHER SOCIAL MEDIA. PLEASE DO NOT INCLUDE VIDEOS WITH COPYRIGHTED MUSIC.

2026 CONSIGNOR TERMS AND CONDITIONS

Pendleton Cattle Barons Committee is listed as PCBC in this contract. Western Legacy Horse Sale is. listed as WLHS in this contract.

The seller hereby agrees to the terms and conditions set forth herein:

1. I own title to each animal entered by me and agree to defend title against all claims; I appoint WLHS as my agent in the named sale at public auction of the named animals, with full authority to transfer title and to receive the proceeds of such sale for my account. I covenant and agree to indemnify and hold harmless WLHS and PCBC from any and all costs, liabilities and sundry expenses (including attorney’s fees) incurred because of or arising out of any question of title to any or all the named animals resulting from any liens, attachments or claims against the net proceeds from the sale thereof. I agree also that title to, interest in and possession of the named animal(s) shall remain with me until title passes to the buyer(s) at the time of the sale.

2. I represent that all information furnished by me on the consignment form is true and correct to the best of my knowledge, information and belief.

3. I agree to be bound by the “consignor’s contract”, which I have read, and further agree to hold WLHS and PCBC harmless from any damage to me or mine in the event that unusual, or unforeseen circumstances result in the change of location, change in time or date, cancellation or similar modification of the named sale. I also warrant that I have read the enclosed Conditions of Sale Entry and agree to abide by them.

4. I understand and agree sale and event managements, auctioneer, or employees of the sale will not be held responsible for any accident that may occur to horses, personnel, or persons attending the sale, or for any loss of any kind to horses or equipment through any cause, including fire, theft, or injury. I understand that PCBC will provide pens or stalls for animals, but that I am responsible for their care, custody and control until delivered to a buyer, at which time he will assume that responsibility.

5. I agree that WLHS shall deduct from my account and retain a sales commission of 8% of the final selling price of my consignment. In the event my sale entry does not meet my recorded reserve price I will pay a pass out fee of $300.00. See #17 below.

6. I agree that PCBC shall have the power to: 1) Reject any entry at any time. 2) Determine order of sale of all entries. 3) make any special announcements at time of sale concerning any animal entered which in the opinion of PCBC are deemed appropriate.

7. I agree to deliver to PCBC the entry fee, original registration papers on registered horses and signed transfer of each registered horse nominated by me to the named sale. I agree to present to sale office all required brand inspection papers, and the original Coggins Test results on each horse entered no later than Friday, May 1st, 2026, at 10:30 AM. I acknowledge that my horse will not sell without the original negative Coggins Test results and health. In the event that my horse is descended from the stallion Impressive, I will present the HYPP N/N test results. I agree that WLHS and PCBC may withhold any monies due me until such requirements are met by me. I further agree that, in the event any animal entered by me is purchased by me or my agent, WLHS and PCBC shall have the right to hold the certificate of registration of such animal(s) pending settlement of all charges payable by me to WLHS and PCBC. The total entry fees must be paid before any horse is included in the sale catalog.

8. I agree that the auctioneer will settle any bidding dispute and his decision will be final.

9. I agree to file with the horse sale office, a reserve price form declaring whether there is a reserve price on the horse selling and if so, the dollar amount the reserve has been set at. At or anything above the auction management has the authority to sell without further discussion. Anything less will be a no-sale and I will pay a pass out fee of $300. The only exception will be if I or an authorized agent is present at ringside when the horse is selling and verbally give permission for the horse to sell below the set reserve price before the horse leaves the ring. In this instance, I will pay the regular commission of 8% on the final selling price and no pass out fee.

10. Payment of net proceeds will be made to consignors when buyer’s checks clear the bank pursuant to normal banking procedures or 10 banking days. I further agree that WLHS and PCBC without duty or investigation may accept personal checks from any bidder in payment of consignments and upon receipt of said check may release the horse(s) to said bidder.

11. I agree also to abide by all established customs and practices of sales conducted by WLHS and PCBC.

12. Entry fees are non-refundable.

13. I agree that I will not sell or offer for sale the animal between the date of this application and the date of the sale for which animal is accepted.

14. Arbitration of Disputes: Any dispute or claim in law or equity between Buyer and Seller arising out of this contract or any resulting transaction which is not settled through mediation shall be decided by neutral, binding arbitration and not by court action.

15. I hereby acknowledge by my signature on this consignment form that I will not use medications of any kind on the horses I have consigned to mask or alter temperament or lameness. Any horse found to have been medicated to mask or alter temperament or lameness will be removed from the sale and all fees forfeited.

16. I guarantee that the horse I am entering in the sale is sound of eyes, wind and limb; has not been nerved, is not foundered and is not proud cut or stagy; does not crib and is not a wind sucker. Any MARE entered is not bred nor been exposed to breeding and consignor has disclosed any breeding related information on the horse. Any exceptions to this rule must be approved by Sale Management prior to the sale, printed in the sale catalog, and announced in the ring during the sale.

17. Once the auctioneer's gavel falls, title to and ownership of the animal passes to the successful bidder unless a previously established reserve price has not been met. In that case the horse will be a no sale, and the consignor will pay a $300.00 pass out fee. Further, should I or my agent, repurchase or no-sale the animal at any price equal to or above the reserve price, I agree to pay the regular commission of 8% on the final selling price with no pass out fee. In addition, anyone selling a passed out or no-sale horse on the grounds or to a registered buyer after the sale agrees to run the transaction through the PCB sale office and pay the regular commission of 8%. The animal nor any paperwork will be released from the property until all charges are paid in full.

18. I represent that I have read the foregoing terms and conditions of the sale, that I agree to abide with them, and have signed this contract with full and complete understanding thereof.

I have read the enclosed Consignor's Contract and Conditions of Sale Entry and agree to abide by them.
